i agree with you on the fact that they wont kill again fully. i just worry that if people get too used to the death penalty then we'll get people who will use that option at anything "he stole something frpom a store give him the death penalty so he won't commit the crime again" granted that seems a lil far fetched but its still a possibility. like wise with Sci-fi i was watching a masters of science fiction programme and one story came on where a man had killed two officers but for good reasons. he was defending himself from them and the judge in this story was an AI which just wanted to give him death right away without listening to his tesamony.
